German commercial leases give the parties broad freedom — almost everything is negotiable, and little is protected by default. In Frankfurt’s competitive market these clauses deserve attention.

Term and extension

Fixed terms of five to ten years are common, usually with an extension option. A fixed lease normally cannot be ended early — match the term to your planning horizon.

Deposit and rent adjustment

Expect two to three months’ deposit, often as a bank guarantee. Check the adjustment clause: a Staffelmiete sets fixed steps, an Indexmiete ties rent to inflation — material over a long term.

Service charges, fit-out and hand-back

Ask for last year’s Nebenkosten statement, clarify who funds fit-out, and agree in writing which alterations may stay — a restoration clause can be costly.
